This is a serious legal question. By law in Pennsylvania, I cannot “throw him out” because he has established residency via receiving mail at my address. I cannot file with the district justice for an eviction because there is no lease or rental agreement. I cannot afford an attorney right now. There must be some way I can have him removed. In the absence of lease tenancy is usually considered month to month. You can have a third party person serve him with a 30 day notice to end his tenancy.

I suggest a third party because you will want an uninvolved witness to the fact that he received the notice. I would also have the person do a notarized statement explaining that the notice had been delivered to your brother. In 30 days when he doesn’t leave, I would contact the sheriff’s department for help.

I think you should send a notice to vacate the property and that failure to do so will be deemed a trespass. Usually, your local police station has a mechanism whereby you send them a copy of the trespass notice and they will enforce it. Since you own the home, you can choose who may be there and who cannot be there.

Then, if he fails to leave, you can call the police.
